Terms of sale

Any reservation request made with the company YOUR DRIVER BRETAGNE entails the acceptance of the present General Conditions.
General:

The prices indicated are inclusive of all taxes (VAT included) in Euros (€).
The fare does not take place instead of the race.
The mileage is deducted from the garage - return garage (56100 LORIENT).

The reservation can be made 5 minutes before the race.
In case of breakdown it will be possible to call another company to make the transfer. The next race will therefore be free of charge.
Prices are subject to change without notice. The kilometers and the time are counted departure garage and return garage. The prices indicated on my quotations are valid for 15 days.
I accept payment by check, cash and credit card.
All benefits are payable in cash before and after the engagement. In all cases, the sponsor of the requested service is solely responsible for his / her payment in the event of the user's failure, including in the event of a previous or subsequent invoice request being moved.
In case of late payment, penalties for delay will be applied without any recall being necessary. They run automatically as of the day following the settlement date shown on the invoice or, failing that, the thirty-first day following the date of performance of the service. The applicable penalty rate is set at three times the legal interest rate.

For long-term services and for clients in the account, the payment of the invoices may be subject to a weekly or periodic payment. In the event of late payment, my company has the right to suspend or cancel orders for services in progress without prejudice to any other remedy.






Article 1: prices shall include VAT at the rate in force for transport operations (on 1 January 2014, the rate shall be 10% for a transfer and 20% for a supply), the driver's service, The expenses of the vehicle for services in Brittany, professional insurance etc ...
Prices include drinks, sweets, magazines, newspapers, charger.

 

Between 8:30 pm and 6 am there is a +25% increase for night hours compared to the regulations in force.


On weekends a surcharge of 25% more is added.



Prices do not include parking and tolls, entrance fees (museums, theaters, castles ...), bulky items (males, bicycles ...).
Waiting at an airport is free for 15 minutes, but after an extra charge will be asked.
Overtime not included in the requested service. Any excess of schedules following new directives and not foreseen on reservations or quotations will incur an additional cost to the customer. The same applies for extra kilometers not booked during the booking and excluding plugs and work on the road.
For animals, there are no supplements, however to go to the veterinarian without the master, the price is the same as for a customer.
For luggage there are no supplements unless more than 20 kg. The volume of luggage carried is proportional to the capacity of the vehicle. The accepted baggage remains in the custody of the latter. I am not responsible for forgotten items in my vehicle or elsewhere during the performance. An insurance will be put in place in case of deterioration of the luggage.

Any complaints must be made within eight days of the delivery by registered post AR, after this period, they can not be taken into consideration. In the event of a dispute, the Commercial Court of Lorient (Morbihan) has sole jurisdiction.




For all services of more than 4 hours, except transfers, including the time slot between 11.30 am and 2 pm or between 7 pm and 9 pm a driver's meal at 20 euros (not subject to VAT) will be charged at an additional cost (Overnight stay and breakfast: 80 euros) or abroad (package 1 night and breakfast: 130 euros). All this will depend on the tariffs of the establishments of the regions traversed.

Article 2: reservation and payment:
By phone, SMS, email address, website.
The reservation of the service will become contractual and will be considered as firm and final between the parties after return of confirmation of the service by YOUR DRIVER BRETAGNE. If a quote has been requested by the customer, it must be returned as soon as possible to YOUR DRIVER BRETAGNE signed and accepted by the customer with the mention "good for agreement".
Reception at the station or at an airport can be done by placing a sign with the name of the client (s) or the names of the accompanying persons or the company following the clients.
The customer can send a message once to warn me and a message can be sent to the client (s) to prevent that I am
on the spot.
The customer can pay in advance and once the service is completed.
For services of more than 80 euros a deposit of 40% may be required if payment is not made immediately.
This deposit must be paid at the latest when the customer sends the acceptance of the estimate, with the words "for agreement", the total balance will be made to the driver once the place of destination reaches the same Means of payment indicated above or later with a scheduled payment date.
Any untimely time and / or kilometer overrun, excluding plugs and work on the road, will be added to the final invoice. Any hour begun is due.
Interim payments are not refundable. Any cancellation by the customer of a reservation, whatever the cause, entails for him the loss of the deposit, as a fixed and irreducible indemnity. In the event that a down payment has been received by the driver at the time of the reservation of the service, this will be deducted from the total amount of the customer's invoice.

Article 2-1: payment of the service for professionals: at the request of certain professional customers, invoicing may be established within a maximum period of 60 days following the date of issue of the invoice.
 

Article 2-2: delay or default of payment (private and professional). Any delay or failure to pay may entail ipso jure: Immediate payment of the remaining amount due. Article 3: for reservations made in advance of more than 8 days, any cancellation of the customer intervening between 7 and 2 days before the beginning of the service: 10% of the amount will be invoiced. Less than 48 hours in advance: 75% of the amount of the service will be charged and for any reservation canceled 24 hours before the service: 100% of the amount will be charged.

Article 4: route:
The kilometers are calculated from the GPS of the car, or from a web site of route calculation, the exact address must be communicated with the number, the name of the street, the municipality or the place- Said in order to limit the problems of taking care of the customer and the cost of the service. Any change of itinerary following an incident or unexpected traffic can not in any case be an argument for the customer to claim the refund of the service and in no case a reason for the driver to modify the tariff of the service . Only the change of itinerary requested by the customer and with the agreement of the driver may be subject to an additional charge.


Article 5: Highway Code, Regulation in the vehicle:
The responsibility of the driver being engaged during the period of the services, I have instructions to respect and enforce the road regulations and the laws in force. In the event of delay by airplane or train I would not be held liable, under no circumstances will the customer require the driver to exceed the authorized speed limit or commit traffic violations. In the same way. I forbid to take recourse to any enterprise or action, contrary to morality or good morals. The customer agrees to maintain a correct attitude, not to smoke, not to consume narcotic products or alcoholic beverages inside the vehicle. Article 6: Baggage, personal effects:
The amount of luggage is proportional to the volume of the luggage compartment of the vehicle and must therefore fit in the trunk of the vehicle and be of a reasonable size and with a weight limited to 20 kg per passenger. Inform the vendor of the reservation for the luggage exceeding the weight indicated and for the bulky items to be carried by the luggage or other objects should not present any risk of deterioration of the vehicle. Article 7: Right and application in case of disputes:
The present general conditions of sale, as well as all the contractual relations which may result from this are subject to French law. In the event that a dispute arises between the client and YOUR DRIVER BRETAGNE, the parties undertake to seek an amicable solution, taking into account the interests of each of them before commencing any legal action. Otherwise, the French courts will be competent and, in particular, the Lorient court.
